The bidder must confirm that no exclusion grounds apply to it or, where relevant, to its representatives. These include convictions within the previous five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking; unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, administered assets or suspended business; serious professional misconduct; competition-distorting agreements; conflicts of interest or involvement in preparing the procurement that cannot otherwise be remedied; serious or repeated failures under previous contracts; false or misleading information, failure to provide required information or documents, or improper attempts to obtain confidential information; and relevant national grounds, including unlawful employment of foreign nationals, international sanctions, tax offences and any stated restrictions based on the bidder’s country of establishment. Tax debts below EUR 100 or debts subject to an approved payment schedule are treated in accordance with applicable law. The bidder must also confirm that it will not use subcontractors or suppliers for more than 10% of the contract value if they are Russian nationals, residents or entities established in Russia; are more than 50% directly or indirectly owned by such persons or entities; or act on their behalf or under their direction. A bid that would result in a contract prohibited under the applicable sanctions rules will be rejected.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least two design contracts during the 36 months preceding the start of the procurement. Each contract must concern the design of a publicly accessible area of at least 100 m² or an outdoor sports facility. The bidder must provide a list stating each contract’s subject, building register code, value, performance period and the other contracting party’s details, including a contact person’s telephone number and email address. The services must be delivered by a project manager with at least the qualification of authorised landscape architect, level 7, or an equivalent professional qualification. The project manager must also have managed at least two landscape architecture design projects during the five years before the tender submission deadline. Each reference project must have had a value of at least EUR 35,000 excluding VAT, and the project manager must have acted as the contractor’s design project manager. Submit the project manager’s CV using Appendix 4; the person must be the same as the one identified in the procurement passport. If the project manager is not employed directly by the bidder, include that person’s signed consent to participate in performing the contract. The bid must comply with the tender documents; conditional bids are not permitted. Submit the price in the prescribed structure and explain and evidence equivalence where applicable. In a joint bid, the participants must appoint an authorised representative and submit their power of attorney. Identify any trade secrets in the bid and explain why the information qualifies as such; price and other specified evaluation figures may not be designated as trade secrets.
