Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder will be excluded if it, or a member of its management, supervisory or administrative body or an authorised representative connected with the procurement, has been convicted of participation in a criminal organisation, breach of professional integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawfully enabling a foreign national to work, unlawful use of child labour or human trafficking. A bidder or relevant representative subject to an international sanction will also be excluded. The contracting authority may also exclude a bidder on other grounds set out in the applicable public procurement legislation. A bidder with outstanding national taxes, duties or environmental charges, or unpaid taxes or social security contributions under the law of its country of establishment, will be excluded. The contracting authority will check this for bidders registered in Estonia. A foreign bidder may be asked to provide a certificate from the competent authority in its country if the information cannot be verified through publicly available records. Bidders, including each member of a consortium, must confirm that no exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder, or the consortium together with a subcontractor participating in the bid, must have completed at least three wastewater pump sales contracts during the last three years. The bidder must submit a list of its most important contracts from that period, identifying the other parties to each contract, using Form KII. The bid price must be entered in the structure specified in the procurement register’s pricing worksheet. The bid must include the bid notice using Form PI and confirmation that it complies with the tender documents; conditional bids are not permitted. The offered equipment must meet the technical requirements in the tender documents. Submit a PDF in Estonian or English containing technical information about the equipment, including performance curves, in sufficient detail for the contracting authority to assess compliance. Consortium members must appoint an authorised representative from among themselves and submit a power of attorney for that representative. If the bidder relies on a subcontractor’s capacity to meet the qualification criteria, it must submit that subcontractor’s confirmation using Form KIII. The bidder must confirm that it will not engage, for more than 10% of the contract value, subcontractors or suppliers that are Russian citizens, residents or entities established in Russia, or entities more than 50% owned by such persons or entities, or acting on their behalf or under their instructions. The offered goods must not be subject to international sanctions or originate from sanctioned regions.
