Compliance requirements
The bidder must be excluded if it, or a member of its administrative, management or supervisory body, an authorised representative, or another person empowered to represent, decide for or control it, has been convicted of participation in a criminal organisation, breach of the duty of integrity or a corruption offence, fraud, a terrorist offence or related aiding or attempted conduct, money laundering or terrorist financing, or offences involving the unlawful employment of foreign nationals or the unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has public tax, duty or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment.
The contracting authority may also exclude a bidder for a serious or persistent breach of a material term of a previous public contract that resulted in termination, withdrawal, a price reduction, damages or a contractual penalty, or for providing false information about compliance with qualification requirements or failing to submit that information or requested supporting documents.
Companies established or resident in the Russian Federation or the Republic of Belarus are not permitted to participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of at least EUR 40,000 excluding VAT. The bidder must provide a list stating each contract’s performance period and the other contracting party’s details, including the client representative’s telephone number and email address, and the procurement reference number where applicable. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant expense.
The bidder must include in its team:
- A worker with valid switching rights for the operations required on the 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the deadline for submission of tenders. For works involving only low voltage (0.22–1 kV), low-voltage switching rights are required; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV). The relevant training procedure must be followed.
- A person designated as responsible for the work operation, registered in the partner portal before the tender submission deadline.
- A person leading the electrical works who, as of submission, holds valid A-level competence and/or a qualification of at least level 6 under the Professions Act, has the corresponding proof, and is registered in the partner portal before the tender submission deadline.
The price must be submitted using the required price table, with every unit-price field completed. The bidder must take account of the instructions for completing document V178. The offer must be unconditional and comply with all procurement documents; additional conditions are not permitted. The bidder must provide the name, position and contact details of the person or persons authorised to sign the contract, and the contact person for contract-performance matters. A power of attorney must be included if signing authority does not arise from the articles of association.
Payment is due within 14 calendar days after receipt of the invoice for contracts worth up to EUR 59,999; 35 calendar days for contracts worth EUR 60,000–249,999; and 45 calendar days for contracts worth EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period.
The bidder must identify and justify any information in its tender claimed as a trade secret; the price and price components, as well as specified evaluation-related figures or characteristics, may not be designated as trade secrets. The bidder must not be established or resident in Russia or Belarus. No materials, equipment or goods, including components, originating from or produced in Russia or Belarus may be installed or used; the contracting authority may request certificates of origin. No award criteria are specified in the provided documents.
