Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

A bidder must be excluded if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorist offences, money laundering or terrorist financing; offences involving the unlawful employment of foreign nationals or breaches of their employment conditions, including underpayment; or offences involving the unlawful use of child labour or human trafficking. A bidder must also be excluded for outstanding national taxes, public charges or environmental charges, or unpaid taxes or social security contributions under the law of its country of establishment. The contracting authority may exclude a bidder for materially or persistently breaching an important term of a previous public contract where this led to termination, withdrawal, a price reduction, damages or a contractual penalty. It may also exclude a bidder that provided false information about meeting the qualification requirements or failed to provide that information or requested supplementary documents. Participation is not permitted for undertakings established or resident in Russia or Belarus.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement; at least one contract must be worth €40,000 or more excluding VAT. The bidder must submit a list stating each contract’s performance period and the other contracting party’s details, including a contact person’s telephone number and email address, and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant expense. The team must include a person with valid switching rights for the switching operations required for the works, registered in Elektrilevi’s partner portal before the bid submission deadline. The required rights depend on the voltage level: for works limited to 0.22–1 kV, at least low-voltage switching rights are required; otherwise, both low- and medium-voltage switching rights are required, including where medium-voltage switching is needed for low-voltage work. The team must also include a person responsible for the work operation, registered in the partner portal by the bid submission deadline, and a person leading the electrical works with valid A-level competence and/or a qualification of at least level 6, holding the relevant evidence and registered in the portal by that deadline. The bid must include the price in the prescribed table, with every unit-price field completed, and must comply with the tender documents without additions or conditions. The bidder must provide the name, position and contact details of the person(s) authorised to sign the contract, as well as those of the contract-performance contact person; a power of attorney must be included if signing authority does not derive from the articles of association. The bidder must identify and justify any information claimed as a trade secret; prices and other specified evaluation-related figures may not be classified as trade secrets. The standard payment period after receipt of the invoice is 14 calendar days for contracts up to €59,999, 35 days for contracts from €60,000 to €249,999, and 45 days for contracts of €250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. Materials, equipment and goods installed or used in the works, including components, must not originate from or be produced in Russia or Belarus; the contracting authority may request certificates of origin. The notice does not state an award criterion.
