Compliance requirements
The bidder will be excluded if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation; breach of the duty of integrity or a corrupt act; fraud; a terrorist offence or related offence, including incitement, aiding or attempted commission; money laundering or terrorist financing; enabling unlawful employment of a foreign national or breach of conditions for their employment in Estonia, including payment below the statutory minimum; or unlawful use of child labour or human trafficking. The bidder will also be excluded for outstanding national tax, payment or environmental charges, or tax or social-security contributions owed under the law of its country of establishment.
The contracting authority may exclude a bidder for a serious or persistent breach of an earlier public contract that led to termination, withdrawal, a price reduction, compensation or a contractual penalty, or for providing false information about qualification or failing to submit requested information or documents. Companies established in Russia or Belarus are not permitted to participate. The bidder must confirm that none of the applicable exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to this procurement during the 60 months preceding the start of the procurement. At least one contract must have a value of at least EUR 40,000 excluding VAT. The bidder must provide a list stating each contract’s performance period, the other contracting party and its representative’s contact details, including telephone number and email address, and the procurement reference number where applicable. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The bidder must have an electrical works manager with a valid A-level competence and/or a qualification of at least level 6 under the Professions Act, supported by evidence valid at the time of submission. This person must be registered in Elektrilevi’s Partner Portal before tenders are opened. The bidder must also have a worker with valid switching rights for the operations required by the works, registered in the portal before tenders are opened. For low-voltage works only (0.22–1 kV), low-voltage switching rights are sufficient; otherwise both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side (over 1–20 kV). The switching rights are to be obtained in accordance with procedure J387. A person responsible for the work operation must also be appointed and registered in the portal before tenders are opened; the applicable instructions are J31 and J3284.
The price offer must use the provided form, and every unit-price field must be completed. The offer must accept all procurement-document requirements without additional or conditional terms. The bidder must identify the person(s) authorised to sign the contract and provide their names, titles and contact details, as well as the contract-performance contact person’s details. A power of attorney must be included if signing authority does not arise from the articles of association. The bidder must identify and justify any information claimed as a trade secret; prices and other evaluation-related figures may not be classified as trade secrets.
The standard payment period, counted from receipt of the invoice, is 14 calendar days for contract values up to EUR 59,999, 35 days for values from EUR 60,000 to EUR 249,999, and 45 days for values of EUR 250,000 or more. Participation in the contracting authority’s factoring programme gives a 95-calendar-day payment period. The bidder must confirm that materials, equipment and goods, including components, installed or used in the works are not produced in or sourced from Russia or Belarus; certificates of origin may be requested.
