Compliance requirements
The bidder will be excluded if the bidder or a person authorised to represent, direct or control it has been convicted of participation in a criminal organisation, breach of professional integrity or corruption, fraud, terrorist offences or related conduct, money laundering or terrorist financing; offences involving the unlawful employment of foreign nationals or payment below the legally required wage; or illegal child labour or human trafficking. Exclusion also applies if the bidder has outstanding state tax, social security contribution or environmental charge debts, or if awarding the contract would breach an international or Estonian government sanction. The bidder must confirm that these grounds do not apply. Foreign bidders must provide the specified criminal-record and tax-authority certificates, or equivalent evidence where the relevant documents are unavailable or incomplete.
Qualification criteria and exclusion grounds
The bidder must be registered in a commercial or equivalent register where registration is required by the law of its country of establishment. A foreign bidder must provide a valid registration certificate or equivalent evidence; the contracting authority will check the details of bidders registered in Estonia.
The bidder and/or its subcontractor must have completed at least one contract similar to the transport of oil shale fuel oil during the 36 months preceding the start of the procurement. The bidder must provide the completed contract list, including values, dates and the other contracting parties, using the “List of Contracts” form, and confirm that the reference contract was properly completed.
The bidder and/or its subcontractor must have valid ADR certificates for the drivers and transport vehicles, with copies of supporting documents submitted.
If the bidder relies on another entity’s resources to meet the qualification requirements, it must identify that entity and demonstrate that the resources will be available for contract performance. If it relies on another entity’s authorisation to carry out an activity, that entity must personally perform the relevant part of the contract, and the relied-upon subcontractor must be identified in the bid.
The bid must comply with the procurement documents; conditional bids are not permitted. Prices must be entered in all required fields of the contracting authority’s calculation form, in euros excluding VAT. Any claimed equivalence must be explained and supported by evidence. Joint bidders must appoint an authorised representative and submit a power of attorney. The bidder must identify and justify any trade secrets; prices, price components and other numerical figures used for evaluating service bids cannot be designated as trade secrets. The bidder must disclose known circumstances that could create a conflict of interest or an unfair competitive advantage and provide explanations where applicable. No award criterion is specified in the provided document text.
