Compliance requirements
A bidder will be excluded if the bidder, its representative, a member of its management or supervisory body, or another person controlling the undertaking has been convicted of participating in a criminal organisation, corruption, fraud, terrorism or its financing, money laundering, facilitating unlawful employment, or the unlawful use of child labour or human trafficking. Outstanding tax, payment or environmental charges are also grounds for exclusion.
The contracting authority may exclude a bidder that has seriously or repeatedly breached a material term of a previous public contract where this resulted in termination or withdrawal from the contract, a price reduction, compensation for damages or a contractual penalty. Exclusion may also follow from providing false information about compliance with the qualification requirements or failing to submit required information or additional documents.
Undertakings established or resident in the Russian Federation or the Republic of Belarus may not participate in the procurement.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the procurement subject. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must provide a list of contracts stating their performance periods, the client representative’s contact details (including telephone number and email address), and, for public procurement contracts, the reference numbers. The contracting authority may request evidence of proper performance if it cannot obtain the information from databases without significant expense.
Before bids are opened, the bidder must have a worker with valid switching authorisations registered in Elektrilevi’s Partner Portal. For switching operations related to the works on a 0.22–20 kV network, both low-voltage and medium-voltage switching authorisations are required, except where the procurement concerns only low-voltage works of 0.22–1 kV; in that case, low-voltage switching authorisations are sufficient. Applications for authorisations must follow document J387.
The bidder must also have a person responsible for the work operation (C-person) with valid rights registered in Elektrilevi’s Partner Portal before bids are opened. Applications for these rights must follow documents J31 and J3284. The bidder must also have a person managing the electrical works who holds a valid A-level competence and/or a qualification of at least level 6 under the Professional Qualifications Act, with evidence of the qualification valid at the time of bid submission. This person must be registered in the portal before bids are opened.
The bid must include a price table using the form in the procurement documents, with every unit-price field completed. The preparation of the bid must take account of the completion instructions for management system document V178. Bids with additional conditions or conditional bids are not permitted; submitting a bid constitutes acceptance of the procurement-document conditions.
The bidder must provide the name, position and contact details of each contract signatory, as well as the details of the contact person for contract performance matters. If a signatory’s authority is not established by the articles of association, a power of attorney must be included. The bidder must identify and justify any information it considers a trade secret; the bid price and figures relevant to the award criteria may not be designated as trade secrets.
Under the contracting authority’s standard terms, invoices are payable within 14 calendar days for contracts valued up to EUR 59,999, 35 calendar days for contracts valued from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts valued at EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a payment period of 95 calendar days from receipt of the invoice.
Materials, equipment, goods or components manufactured in or originating from the Russian Federation or the Republic of Belarus must not be used in the works. The contracting authority may request certificates of origin.
