Compliance requirements
A bidder may be excluded if it or a person authorised to represent, manage or control it has, within the past five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour or human trafficking offences. Exclusion may also apply for unpaid taxes or social security contributions, enabling a foreign national to work without a legal basis or in breach of employment conditions, or if awarding the contract would violate an international or Estonian government sanction. The bidder must provide the relevant declarations and information. For applicable grounds, it may submit evidence of measures taken to restore its reliability where the law or procurement documents allow this. The notice explains that a tax-debt certificate is not issued where the relevant tax debt is below EUR 100 or payment has been deferred; foreign bidders’ tax-debt evidence is governed by the law of their country of establishment.
