Compliance requirements
The bidder and its representatives may be excluded for relevant criminal convictions within the previous five years, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, terrorist financing, child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation or comparable circumstances; suspended business activity; serious professional misconduct; competition-distorting agreements; unmanageable conflicts of interest; involvement in preparing the procurement that creates an unavoidable competitive advantage; serious or repeated breaches of earlier contracts resulting in termination, damages or penalties; false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information improperly. Exclusion may also apply for enabling the unlawful employment of a foreign national, being subject to an international sanction, or relevant tax offences. The tax and social-contribution debt threshold is stated as EUR 0; under the Estonian note, a tax certificate is not issued for debt below EUR 100 or where payment has been deferred. Where applicable, the bidder may provide evidence of remedial measures to demonstrate restored reliability, if the procurement is above the international threshold or the tender documents allow this.
Qualification criteria and exclusion grounds
The bidder must be an insurer entitled to conduct insurance business in Estonia, either under an Estonian authorisation, through an Estonian branch, or as a cross-border insurer that has notified the Estonian Financial Supervision and Resolution Authority. The bidder may tender only for insurance classes covered by its authorisation. The contracting authority will check the public information of the Authority; if the bidder is not listed, it must provide copies of documents proving compliance when requested. The bidder must have a claims-handling department in Estonia or a local claims-handling partner.
For a joint tender, the joint bidders must appoint an authorised representative from among themselves and include the authorisation. If the person submitting the tender is not a board member recorded in the commercial register with authority to represent the bidder, a power of attorney must be provided. By submitting a tender, the bidder confirms acceptance of all tender-document conditions; conditional tenders are not permitted. The price must follow the structure set out on the award criteria and assessable items sheet. Any information claimed as a trade secret must be identified and the designation justified. The tender price, component prices, and, for services, numerical figures relating to the award criteria may not be designated as trade secrets. The supplied text does not specify the detailed award criteria or their weightings.
