Compliance requirements
A bidder may be excluded if it, or a member of its administrative, management or supervisory body or an authorised representative, has received a relevant final conviction within the past five years, or remains subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, a terrorist offence or related activity, money laundering or terrorist financing, or the use of child labour or human trafficking. Where permitted, the bidder may submit evidence of measures taken to restore its reliability.
Exclusion grounds also include failure to pay taxes or social security contributions in the bidder’s country of establishment or the contracting authority’s country. The notice states a threshold of EUR 0. It also explains that, under Estonian rules, a tax-debt certificate is not issued where the debt is below EUR 100 (excluding interest not established by an administrative act) or where payment has been deferred; foreign bidders are assessed under the rules of their country of establishment. A bidder may also be excluded for a relevant conviction for enabling the employment of a foreign national staying unlawfully or for breaching rules on a foreign national’s employment in Estonia. The contract may not be awarded if doing so would violate an international or Estonian government sanction.
