Compliance requirements
Exclusion grounds cover convictions of the bidder or its management, administrative or supervisory body members or representatives for specified offences, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, child labour or human trafficking. They also cover outstanding taxes or social security contributions. For Estonian tax arrears, the notice sets the threshold at EUR 0 and explains that the tax authority does not issue a debt certificate where the debt is below EUR 100 or payment has been rescheduled.
Other possible grounds include breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, assets being administered by a liquidator or court, or suspended business activity; serious professional misconduct; anti-competitive agreements; conflicts of interest; involvement in preparing the procurement in a way that distorts competition; significant or repeated breaches of a previous public contract; and providing false information, withholding required information or documents, or improperly obtaining confidential information. The grounds also include enabling a foreign national to work in Estonia without a legal basis or in breach of employment conditions, entering into a contract with a person subject to international sanctions, convictions for tax offences, local tax arrears in the contracting authority’s area, and lack of the right to participate because of a restriction specified in the tender documents.
The bidder must confirm that more than 50% of its ownership is not held, directly or indirectly, by Russian nationals, residents of Russia or entities established in Russia, and that it does not act as their representative or under their instructions. It must not engage prohibited Russia-linked subcontractors or suppliers for more than 10% of the contract value, or rely on their capacities to meet the selection criteria. The contracting authority may request evidence concerning ownership, beneficial owners, subcontractors and suppliers. A bid will be rejected if the resulting contract would be void under the sanctions rules.
