Compliance requirements
The bidder must confirm that neither it nor its relevant management, supervisory or representative persons are subject to exclusion grounds. These include final convictions within the preceding five years, or a continuing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. The grounds also cover unpaid taxes or social security contributions; breaches of social, environmental or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, comparable proceedings, administration of assets by a liquidator or court, or suspension of business; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an advantage which cannot otherwise be addressed; serious or repeated failure to perform an earlier contract resulting in termination, damages, a price reduction or a contractual penalty; and false or misleading information, withholding required information or documents, or improperly seeking confidential information. National grounds also cover enabling the unlawful employment of a foreign national, being subject to applicable international or Estonian sanctions, and relevant tax offences. For tax-debt purposes, the notice gives a threshold of EUR 0 and notes that a tax-debt certificate is not issued for debt below EUR 100 (excluding certain unassessed interest) or where payment has been deferred. Where a ground applies, the bidder may provide information about measures taken to restore its reliability where such remedial measures are available. The bidder must also confirm that it will not involve, for more than 10% of the contract value, subcontractors or suppliers falling within the specified Russia-related sanctions categories.
Qualification criteria and exclusion grounds
The bidder’s average annual turnover must be at least EUR 30,000 for the period from 1 January 2023 to 31 December 2025.
Within the 36 months preceding the start of the procurement, the bidder must have duly completed and obtained client acceptance for design services meeting both of these requirements:
- At least one basic or detailed design for removing at least 3,000 m³ of sediment from a water body or dredging at least 3,000 m³ of soil. The minimum volume must be met in a single project.
- At least one basic or detailed design for constructing, reconstructing or cleaning drainage ditches used for stormwater drainage or land drainage, with a total designed ditch length of at least 500 m. The minimum length must be met in a single project.
The requirements may be demonstrated through the same or separate contracts. Work may have started earlier, but the qualifying design work must have been completed and accepted within the stated 36-month period. The bidder may rely on a consortium member’s or another entity’s experience, including a subcontractor’s; an entity whose experience is relied upon must perform the corresponding part of the contract. The bidder must list comparable services and provide information about their scope, value, dates and clients.
The design team must include a design team leader holding either a Level 7 diploma in water supply and sewerage engineering, specialising in external water supply and sewerage and design management, or a Level 7 diploma in hydraulic engineering with competence in preparing construction designs for hydraulic structures, or an equivalent professional certificate from the country of establishment. If the key person is employed by another company, the employer’s confirmation must be included.
The bidder must confirm that its tender complies with the tender documents and explain and provide evidence of equivalence where relevant. A conditional tender is not permitted. The completed tender notice (Form 1) and Part IV lists must be submitted. For a joint tender, the bidders must appoint an authorised representative and provide the required authorisation and joint-bidder confirmation (Form 2). If subcontractors will directly perform part of the contract, the bidder must submit Form 5; subcontractors whose experience is relied upon must also submit a separate ESPD. The bidder must provide the team details in Form 4. The tender must identify any claimed trade secrets and justify that designation; tender prices and specified evaluation-related figures may not be classified as trade secrets. The provided documents do not specify the award criteria; check the official tender documents for them.
