Tartu University Hospital Foundation is procuring ECMO supplies under a framework agreement lasting three years or until the maximum contract value is reached, whichever occurs first. Compliance requirements

A bidder may be excluded if it or a person in its management, supervisory or representative roles has a final conviction within the previous five years, or an exclusion period remains in force, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. Exclusion grounds also include breaches of tax or social-security payment obligations; bankruptcy, insolvency, liquidation, suspended business activity or comparable situations; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unmanageable competitive advantage; and significant or repeated failure to perform a previous public contract resulting in early termination, damages or comparable sanctions. A bidder may also be excluded for false or misleading information, withholding required information, failure to provide requested supporting documents, or improperly seeking confidential information or influencing the contracting authority. National grounds include enabling a foreign national to work unlawfully or in breach of employment conditions, being subject to an international or Estonian government sanction that would make the contract unlawful, and—where applied—conviction for tax offences. Where legally available, the bidder may provide evidence of remedial measures demonstrating restored reliability.

Qualification criteria and exclusion grounds

The bidder must submit a technically compliant offer for the relevant lot or lots, identifying each product’s name, manufacturer, product code, unit price and technical characteristics, and referring to the supporting information by file name and page number. The offer must include the manufacturer’s detailed specifications and instructions for use, together with other Estonian- or English-language materials demonstrating compliance with every requirement in the technical description. Equivalent products may be offered; where equivalence is relied upon, explain it and provide supporting evidence. The bidder must have the right to represent and sell the offered products in Estonia. Provide evidence from the manufacturer or, if the manufacturer is outside the EU, its authorised representative; include documents supporting any onward delegation of that right. Products must be lawfully placed on the market under Regulation (EU) 2017/745 or its transitional provisions and bear the CE mark. Submit copies of the declarations of conformity and, where applicable, EC certificates; clearly identify the products offered if the documents cover multiple products. If requested, bidders whose products were not previously used by the hospital under a contract with that bidder must deliver samples within 24 hours of the request. Samples must be in sealed original packaging and marked with the product name and code/reference number; they will not be returned or reimbursed. Submit the participation declaration in the required form. Joint bidders must appoint an authorised representative and provide the power of attorney and confirmation of joint and several liability. Identify any information claimed as a trade secret and justify that designation; prices and other specified evaluation-related figures may not be treated as trade secrets. Confirm compliance with the tender documents and provide evidence of equivalence where relevant. The bidder must also confirm that offered goods are not subject to international sanctions or from sanctioned regions, and that prohibited Russian-linked subcontractors or suppliers will not account for more than 10% of the contract value. Enter the price for one unit excluding VAT in euros using the prescribed price structure. The price must include all costs of delivery and unloading at the hospital’s Heart Clinic, L.
