Compliance requirements
The bidder will be excluded if the bidder, or a person authorised to represent, manage or control it, has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling the unlawful employment of a foreign national or breaches of the rules governing a foreign national’s employment in Estonia, including paying less than the statutory wage; unlawful use of child labour or human trafficking; or if the bidder has outstanding national tax, duty or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. The bidder will also be excluded if awarding the contract would violate an international or Estonian government sanction. The bidder must provide a free-form confirmation that none of these grounds for exclusion apply.
Qualification criteria and exclusion grounds
The bidder’s average annual turnover for 1 January 2023 to 31 December 2025 must be at least EUR 35,000. The bidder must provide a document in free form describing how this requirement is met, together with a balance sheet signed by its legal representative.
The bid must identify the bidder’s authorised representative, who can represent the bidder and provide explanations if needed, and the bidder’s representative responsible during contract performance (the contractor’s project manager). Their contact details must be provided.
The bidder must have gained experience during the previous 120 months on at least two projects, each involving construction along a minimum 500 m section of an existing paved or gravel road, where the road surface pre-dated the pipe works and two pipes were installed in one trench: a gravity pipe with a diameter of at least De 200 mm and a pressure pipe with a diameter of at least De 110 mm. This experience must be described in the bid.
The team must include the following key experts:
- An owner-supervision team leader holding at least a level 8 authorised water supply and sewerage engineer qualification, specialising in external water supply and sewerage and with owner-supervision competence, or an equivalent qualification from the country of origin.
- A water and sewerage systems owner-supervision specialist holding at least a level 7 diplomeeritud water supply and sewerage engineer qualification, specialising in external water supply and sewerage and with owner-supervision competence, or an equivalent qualification from the country of origin.
- A road construction owner-supervision specialist holding at least a level 7 diplomeeritud road engineer qualification, specialising in road construction and maintenance and with supervision competence, or an equivalent qualification from the country of origin.
The team leader and the water and sewerage systems specialist may be the same person if that person meets the qualification requirements for both roles. The team must be presented using Form 2. If a key expert’s employer participates as a subcontractor or does not participate in the tender, the bidder must provide that employer’s confirmation using Form 1. The bidder must also submit the required tender price form.
