Compliance requirements
The bidder must not have been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing. The same applies to convictions for illegally employing a foreign national or breaching the rules on foreign nationals’ employment in Estonia, including paying below the statutory minimum wage, and for unlawful child labour or human trafficking. The bidder must have no outstanding state tax, fee or environmental charge debts, or tax or social security contribution debts under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a penalty, or that has provided false information about meeting the suitability criteria or failed to submit requested information or documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
During the 60 months before the procurement began, the bidder must have duly performed at least three contracts for electrical construction works similar to this contract; at least one must have had a value of EUR 40,000 or more excluding VAT. Submit a list stating each contract’s performance period, the other contracting party’s details (including the client representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from public or private databases without significant cost.
Before bids are opened, the bidder must have entered in Elektrilevi’s partner portal (EPP) a worker holding valid switching rights for the relevant 0.22–20 kV network switching operations, except at regional and distribution substations. For low-voltage-only work (0.22–1 kV), at least low-voltage switching rights are required. In other cases, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The bidder must also have a person responsible for the work operation entered in EPP before bids are opened.
The bidder must have a person leading the electrical works with valid A-level competence and/or a qualification of at least level 6 under the Vocational Qualifications Act. That person must hold the relevant evidence when bids are submitted and be entered in EPP before bids are opened. The bid must comply with all procurement-document requirements; conditional bids or bids with additional conditions are not permitted. Submit the price using the prescribed table and fill in every unit-price field, taking account of the instructions in document V178. Provide the contract signatory’s name, title and contact details, the basis for their signing authority, and the contract contact person’s details; include a power of attorney if signing authority does not arise from the articles of association. The bidder must confirm that it is not established in Russia or Belarus. Materials, equipment, goods and components installed or used in the works must not be produced in or originate from Russia or Belarus; origin certificates may be requested.
