Compliance requirements
The bidder may be excluded for specified convictions involving the bidder or its representatives, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. The relevant conviction grounds generally cover the previous five years or any exclusion period still in force.
Exclusion grounds also include failure to pay taxes or social security contributions; bankruptcy, insolvency, liquidation or comparable situations; an agreement with creditors; assets managed by a liquidator or court; suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing the procurement where this creates an irremediable competitive advantage; and significant or persistent failures under previous contracts, including early termination, damages or comparable sanctions. A bidder may also be excluded for false or misleading information, withholding required information or documents, improperly seeking confidential information, or breaching applicable environmental, social or labour obligations.
National grounds include enabling a foreign national to work without a lawful basis or in breach of Estonian employment conditions, being subject to an international or Estonian government sanction that would make contract award unlawful, and relevant tax offences. The bidder must declare whether these grounds apply. Tax and social contribution arrears are grounds for exclusion; under Estonian rules, a tax arrear below EUR 100 or an agreed payment schedule is treated as specified in the notice. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
