Compliance requirements
The bidder must not be subject to mandatory exclusion grounds. These include convictions of the bidder or relevant persons authorised to represent, manage or control it for participation in a criminal organisation; breach of integrity or corruption; fraud; terrorist offences or related conduct; money laundering or terrorist financing; unlawful employment of a foreign national or permitting breaches of the conditions for foreign nationals working in Estonia, including payment below the statutory wage rate; or unlawful use of child labour or human trafficking. Exclusion also applies where the bidder has outstanding state tax, duty or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment.
The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important condition of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation for damage or a contractual penalty; or that has provided false information about meeting qualification requirements or failed to submit required information or documents. Companies established in Russia or Belarus may not participate.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for similar electrical construction works during the 60 months preceding the start of the procurement. At least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must submit a list stating each contract’s performance period and the other contracting party’s details, including a contact person’s telephone number and email address; for public procurement contracts, include the reference number. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant cost.
The bidder must have a worker authorised to carry out switching operations on the 0.22–20 kV electricity network for the works, excluding operations at regional and distribution substations. The worker must be registered in Elektrilevi’s partner portal before bids are opened. For low-voltage works only (0.22–1 kV), at least low-voltage switching authorisations are required. In other cases, both low- and medium-voltage switching authorisations are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The applicable training and authorisation procedure is set out in document J387.
The bidder must have a person designated as responsible for the work operation, registered in the partner portal before bids are opened. The relevant authorisation must follow documents J31 and J3284. The bidder must also have a person leading electrical works who holds valid A-level competence and/or a qualification of at least level 6 under the Professions Act, has the required evidence by the bid submission deadline and is registered in the partner portal before bids are opened.
The bid must be unconditional and comply with the procurement documents. It must include a price table using the supplied form, with every unit-price field completed, and take account of the instructions for completing management-system document V178. The bidder must provide the name, position and contact details of each contract signatory and of the contact person for contract matters. If the signatory’s authority is not established by the articles of association, a power of attorney must be included.
The contracting authority’s standard payment period, counted from receipt of the invoice, is 14 calendar days for contracts up to EUR 59,999, 35 calendar days for contracts from EUR 60,000 to EUR 249,999, and 45 calendar days for contracts of EUR 250,000 or more. Participation in the authority’s factoring programme results in a 95-calendar-day payment period.
The bidder must identify any trade secrets in its bid and explain why the information qualifies as such. The bid price, individual price components and specified figures or indicators used to evaluate bids may not be designated as trade secrets. Materials, equipment, goods and components installed or used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The procurement documents do not state award-scoring criteria.
