Compliance requirements
The exclusion grounds cover final convictions within the previous five years, or an exclusion period that remains in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking. These grounds also apply to relevant members of the bidder’s administrative, management or supervisory bodies and persons authorised to represent, make decisions for or control the bidder. Other grounds include unpaid taxes or social security contributions, enabling a foreign national without a lawful basis to stay in the country to work or breaching rules on foreign nationals’ employment, and entering into the contract in breach of an international or Estonian government sanction. The notice indicates a zero-euro threshold for tax and social security arrears; under Estonian rules, a tax-debt certificate is not issued where the debt is below EUR 100 or its payment has been deferred. Where applicable, the bidder may describe measures taken to restore its reliability.
