Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The contracting authority must exclude a bidder if the bidder, or a person with relevant management, supervisory or representative authority, has been convicted of participation in a criminal organisation, breach of integrity duties or corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences relating to enabling illegal employment or breaching the conditions for employing foreign nationals, including paying less than the statutory wage; or unlawful use of child labour or human trafficking. A bidder with outstanding national taxes, duties or environmental charges, or unpaid taxes or social security contributions under the law of its country of establishment, must also be excluded. The contracting authority may exclude a bidder for materially or persistently breaching an important term of a previous public contract where this resulted in termination, withdrawal, a price reduction, damages or a contractual penalty, or for providing false information about compliance with qualification requirements or failing to provide requested information or documents. Enterprises established in the Russian Federation or the Republic of Belarus may not participate. The bidder must confirm that none of these grounds apply.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one contract must have had a value of EUR 20,000 or more, excluding VAT. The bidder must provide a list stating the performance period, the other contracting party’s details (including the customer representative’s telephone number and email address) and, for public contracts, the procurement reference number. Evidence of proper completion must be provided on request unless the contracting authority can obtain it from databases without significant cost. The bidder’s team must include a person with valid switching rights for the switching operations required for the works in the 0.22–20 kV network, excluding regional and distribution substations. For low-voltage works only (0.22–1 kV), at least low-voltage switching rights are required; otherwise both low- and medium-voltage switching rights are required, including when low-voltage works require switching on the medium-voltage side (over 1–20 kV). The person must be entered in Elektrilevi’s partner portal before the deadline for submission of tenders. The team must also include a person responsible for the work operation, entered in that portal before the same deadline. The team must include a person leading the electrical works who holds valid A-level competency and/or a qualification equivalent to at least level 6 under the Professions Act, has the relevant proof at the time of submitting the tender, and is entered in Elektrilevi’s partner portal before the submission deadline. The tender must include a price table in the prescribed format, with every unit-price field completed, and must comply with the tender documents; conditional tenders or tenders containing additional conditions are not allowed. The bidder must identify the authorised contract signatory and the contact person for contract performance; a power of attorney must be included if the signatory’s authority does not arise from the articles of association. Joint bidders must appoint an authorised representative and provide the relevant authorisation. The parsed documents do not specify the award criteria; check the official tender documents for details.
