Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder will be excluded if it or a person authorised to represent, manage or control it has been convicted of participation in a criminal organisation, breach of integrity obligations or corruption, fraud, terrorism-related offences, money laundering or terrorist financing, unlawful employment of foreign nationals, or offences involving child labour or human trafficking. A bidder with outstanding national tax, levy or environmental-charge debts, or tax or social security debts under the law of its country of establishment, will also be excluded. The contracting authority may exclude a bidder for serious or repeated breach of a previous public contract where this resulted in termination, withdrawal, a price reduction, compensation or a contractual penalty. It may also exclude a bidder that provided false information about meeting qualification requirements or failed to provide that information or requested supporting documents. Businesses established or resident in Russia or Belarus are not permitted to participate.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the contract subject during the 60 months preceding the start of the procurement. At least one contract must have had a value of EUR 40,000 or more excluding VAT. The bidder must provide a list stating the performance period, the other contracting parties and their representatives’ contact details, including telephone number and email address, and, for public procurements, the reference numbers. Evidence of proper performance must be provided on request unless the contracting authority can obtain it from databases without significant expense. The bidder must have a worker with valid switching rights for work-related operations on the 0.22–20 kV electricity network, excluding regional and distribution substations. The worker must be registered in Elektrilevi’s partner portal before tenders are opened. For works involving only low voltage (0.22–1 kV), low-voltage switching rights are sufficient; otherwise, both low- and medium-voltage switching rights are required, including where low-voltage work requires switching on the medium-voltage side (over 1–20 kV). The bidder must also have a person appointed to be responsible for the work operation, registered in the partner portal before tenders are opened. The bidder must have a person leading electrical works with valid A-class competence and/or a qualification of at least level 6 under the Occupations Act. That person must hold the relevant evidence when tenders are submitted and be registered in the partner portal before tenders are opened. The tender must comply with the procurement documents; conditional tenders or tenders with additional conditions are not permitted. The price must be submitted using the prescribed table, and every unit-price field must be completed. The bidder must provide the contract signatory’s name, title, contact details and evidence of authority to represent the bidder; if that authority does not arise from the articles of association, a power of attorney must be included. A contact person for contract-related matters must also be named. The bidder must identify and justify any information claimed as a trade secret; the tender price and other specified evaluation-related figures may not be designated as trade secrets. The contracting authority’s standard payment periods, counted from receipt of the invoice, are 14 calendar days for contracts up to EUR 59,999, 35 days for contracts from EUR 60,000 to EUR 249,999, and 45 days for contracts of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. Materials, equipment and goods, including components, used or installed in the works must not be produced in or originate from Russia or Belarus; the authority may request certificates of origin. The bidder must not be established or resident in Russia or Belarus.
