Compliance requirements
A bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent, make decisions for or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity obligations, a corrupt act, fraud, a terrorism-related offence, money laundering or terrorist financing. Exclusion also applies to convictions for enabling unlawful employment or breaching the conditions for employing a foreign national in Estonia, including paying less than the statutory wage, and for unlawful use of child labour or an offence related to human trafficking. The bidder must have no outstanding national tax, levy or environmental charge debt, and no tax or social security contribution debt under the laws of its country of establishment.
The contracting authority may exclude a bidder that has materially or repeatedly breached important terms of a previous public contract, where this led to termination or withdrawal from the contract, a price reduction, compensation for damage or a contractual penalty. Exclusion may also apply where the bidder provided false information about compliance with selection criteria or failed to submit required information or additional documents.
An undertaking established or resident in the Russian Federation or the Republic of Belarus may not participate in the procurement.
Qualification criteria and exclusion grounds
Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the contract being procured. At least one contract must have a value of EUR 40,000 or more, excluding VAT. The bidder must provide a list of contracts showing their performance periods, contact details for the clients’ representatives (including telephone numbers and email addresses) and, for public contracts, reference numbers. The contracting authority may request evidence of proper completion if it cannot obtain the information itself without disproportionate effort.
The bidder’s team must include an employee authorised to carry out switching operations related to the works on 0.22–20 kV electricity networks, registered in Elektrilevi’s partner portal before the tender submission deadline. Switching at regional and distribution substations is excluded from this requirement. For works limited to 0.22–1 kV, low-voltage switching rights are sufficient; in other cases, both low- and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side.
The bidder must have a person appointed as responsible for work operations and registered in Elektrilevi’s partner portal before the tender submission deadline. The team must also include a person leading electrical works who holds valid A-class competence and/or a qualification at level 6 or higher, with supporting evidence; this person must be registered in the portal before the submission deadline.
The bid must use the form specified in the procurement documents, and every unit-price field in the price table must be completed. By submitting a bid, the bidder accepts all conditions in the procurement documents; conditional bids or bids with additional conditions are not permitted. The bidder must provide the name, position and contact details of each contract signatory and the contact person for contract-performance matters. If the signatory’s authority is not established by the articles of association, a power of attorney must be included.
Payment periods, starting when the invoice is received, are 14 calendar days for contract values up to EUR 59,999, 35 calendar days for values from EUR 60,000 to EUR 249,999, and 45 calendar days for values of EUR 250,000 or more. Participation in the contracting authority’s factoring programme results in a 95-calendar-day payment period. The bidder must identify and justify any information designated as a trade secret; the bid price and figures relevant to the award criteria may not be classified as trade secrets. Materials, equipment, goods and components used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin. The machine-readable notice did not specify the award criteria; these must be checked in the tender documents.
