Compliance requirements

Exclusion grounds are checked in relation to the bidder and its management or supervisory body members and representatives. They cover participation in a criminal organisation, corruption, fraud, terrorist offences and related offences, money laundering or terrorist financing, and the illegal use of child labour or human trafficking. Convictions within the previous five years or an exclusion period that remains in force are relevant. In certain cases, the bidder may provide evidence of measures taken to restore its reliability. Other possible grounds include failure to pay taxes or social security contributions; breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation, an arrangement with creditors, administration of assets by a liquidator or court, or suspension of business activities. For tax or social security debt, the notice specifies a threshold of EUR 0; its accompanying information states that a tax-debt certificate is not issued where the debt is below EUR 100 or payment has been deferred. For a foreign bidder, the certificate is issued under the laws of its country of establishment. The checks also cover serious professional misconduct, agreements intended to distort competition, an unavoidable conflict of interest, involvement in preparing the procurement where the resulting advantage cannot otherwise be eliminated, significant or repeated breach of a previous contract, and submitting false or misleading information, withholding information, failing to provide required documents, or improperly obtaining confidential information. A ground for exclusion may also arise from enabling a foreign national who is unlawfully present in Estonia to work, or enabling breaches of the conditions governing a foreign national’s employment in Estonia. The bidder must confirm that concluding the contract with it would not breach an international sanction or a sanction imposed by the Government of Estonia. It must also confirm that the goods offered are neither subject to international sanctions nor from sanctioned regions, and that it is not established or resident in Russia or Belarus.

Qualification criteria and exclusion grounds

Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least one road construction or reconstruction project that included construction or reconstruction of at least 2,000 m² of asphalt road pavement. The ESPD must include a list of the works, stating their title, location, completion period, brief description, asphalt area, client contact details and procurement reference number if the work resulted from a public procurement. The contracting authority may request additional evidence of proper completion from the successful bidder. The bidder must name at least one person responsible for managing the road construction works under the contract. That person must hold a valid professional certificate as a Road Engineer, level 6 or higher, specialising in roads, or an equivalent qualification demonstrating the necessary competence. The bidder must provide the person’s name and certificate details or documents proving an equivalent qualification. The bid must confirm compliance with the tender documents; conditional bids are not permitted. Where equivalence is relevant, it must be explained and supported by evidence. In a joint bid, a power of attorney must appoint a representative for actions related to the procurement and the conclusion and performance of the contract. The bidder must confirm that it will not use a subcontractor during contract performance who would have to be replaced under the law. Goods offered must not be subject to international sanctions or originate from sanctioned regions. The bidder must confirm that it is not established or resident in Russia or Belarus. The bid price must be stated in euros both in the eRHR pricing form, showing the total cost of the works excluding VAT and the client’s reserve, and in Form 1, “Bill of quantities and price offer”. Pricing must follow the structure specified in the form for evaluation criteria and assessable items. If the bid contains trade secrets, the bidder must identify the information and explain why it qualifies; the bid price and figures relating to the evaluation criteria may not be designated as trade secrets.
