Compliance requirements
The tenderer must declare whether it or any person with management, supervisory or representative powers has, within the last five years or while an exclusion period remains in force, been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or child labour or other forms of human trafficking. Where permitted, the tenderer may provide evidence of measures taken to restore its reliability.
The tenderer must also declare whether it has unpaid taxes or social security contributions. The stated threshold is EUR 0; under Estonian rules, a tax-debt certificate is not issued for a debt below EUR 100 (excluding interest not established by an administrative act) or where payment has been rescheduled. Foreign tenderers are assessed under the rules of their country of establishment.
Other national exclusion grounds include permitting a foreign national to work without a legal basis or violating the conditions for foreign nationals’ work in Estonia, including paying below the statutory wage rate; the contract award would breach an international or Estonian government sanction; or the tenderer is not entitled to participate because of an applicable restriction based on its place of establishment. Tenderers, including entities whose capacities they rely on, must be established in Estonia, another EU Member State, an EEA contracting state or a state party to the WTO Government Procurement Agreement. Entities established in Russia or Belarus may not participate. The tenderer must also confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions.
Qualification criteria and exclusion grounds
The tenderer must have completed at least two contracts during the 36 months before commencement of this procurement. Each contract must have covered the supply and installation of barrier gates and induction loops and had a value of at least EUR 30,000. The tenderer must provide the contract scope, date, value, client name and contact details, and, where applicable, the procurement reference number. If relying on another entity’s technical capacity, the tenderer must provide the relevant details and, when requested, that entity’s consent confirming both its support and direct participation in contract performance to the extent relied upon.
The tenderer must have visited at least one of the two harbour sites—Heltermaa or Rohuküla—before submitting its bid and must confirm that it has taken account of the site conditions affecting the scope, method and cost of the works. The bid must include a description of the proposed equipment, including manufacturers, product names and technical data, as well as the warranty period and terms and a maintenance schedule. The completed bill of quantities must be submitted as a spreadsheet, with all unit-price and price cells completed, totals shown before and after VAT at 24%, and prices stated to two decimal places. The buyer’s descriptions, units, quantities and other specified data in the bill of quantities must not be altered or deleted. The price must follow the structure set out in the tender documents.
The person submitting or digitally signing the bid must be authorised to represent the tenderer. A foreign tenderer must provide a document from its country of establishment proving that authority; if the signatory is not recorded in the relevant register, a power of attorney must be provided. Joint tenderers must appoint an authorised representative and submit a power of attorney signed by all of them; they are jointly and severally liable for contract performance. The tenderer must identify authorised persons who are not visible in the relevant business register, by name and personal identification code, or confirm that there are no such persons. A bid relying on equivalent products, standards or evidence must explain the equivalence and include supporting evidence. The tenderer must confirm compliance with the tender documents and carry out the contract in an environmentally responsible manner, including sorting waste for recycling and using environmentally friendly equipment where possible. Any information designated as a trade secret must be identified and justified; bid prices and other specified evaluation-related figures may not be designated as trade secrets. No specific award criterion is stated in the supplied documents.
