Compliance requirements
The European Single Procurement Document asks the bidder to declare whether it or its relevant managers, supervisory-body members or authorised representatives are subject to exclusion grounds. These include convictions within the past five years, or an exclusion period still in force, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking. Other grounds include unpaid taxes or social-security contributions; bankruptcy, insolvency, liquidation, suspended business activity or an arrangement with creditors; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an advantage which cannot otherwise be remedied; and serious or repeated failures under previous contracts resulting in early termination, damages, price reductions or penalties. Grounds also cover false or misleading information, failure to provide required information or documents, attempts to improperly influence the procurement or obtain confidential information, and breaches of environmental, social or labour-law obligations. National grounds include enabling a person without legal grounds to work in Estonia, being subject to international sanctions, and certain tax offences. The bidder may be asked to explain relevant circumstances and, where permitted, provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The provided documents do not specify minimum turnover, prior-experience, staffing or professional-qualification thresholds. The bidder must submit a completed Appendix 2, “Specification of Goods Offered and Price Form,” filling in all blue-marked fields: medicine name, manufacturer and unit price excluding VAT. The offer must follow the prescribed price structure and the goods must meet Appendix 1, the Technical Description. The bidder must confirm that the offer complies with the procurement documents; conditional offers are not permitted. If equivalence is claimed, explain it and provide supporting evidence. The offer must also include the required details for the contract signatory and contact person, and a power of attorney if an authorised representative will sign. Joint bidders must appoint an authorised representative and submit their power of attorney. The bidder must declare that the offered goods are not subject to international sanctions and do not originate from sanctioned regions, and must comply with the stated restrictions on subcontractors and suppliers.
