Compliance requirements
The bidder must confirm that none of the exclusion grounds specified in § 95(1), points 1–5, or § 95(4), point 12, of the Estonian Public Procurement Act apply. If the bidder, a joint bidder, an entity whose capacity is relied upon, or a foreign company’s branch has other persons authorised to represent, make decisions for or control it who are not shown on the commercial register card, the bidder must provide each person’s name and personal identification code, or confirm that there are no such persons. An entity whose capacity is relied upon must also confirm that no exclusion grounds set out in the procurement documents apply.
Qualification criteria and exclusion grounds
The bidder must have completed between 1 and 3 sales contracts for equipment equivalent to the meters being procured during the 36 months preceding publication of the contract notice in the Estonian Public Procurement Register. The contracts must have a combined value of at least EUR 30,000 excluding VAT. Equivalence is assessed by comparing the equipment’s intended use, measurement method and principles, measurement range, accuracy and units. For contracts extending beyond the reference period, only the portion completed within that period counts. Where equipment was acquired under a framework agreement, completed orders under that agreement may be used as references.
The bidder must submit the contract details using Annex 4, including the subject, period, value and the other contracting party’s name and contact details; for public contracts, the reference number must also be given. If the bidder relies on another entity’s capacity, it must submit that entity’s consent using Annex 5, and the entity must participate directly in contract performance at least to the extent of the capacity relied upon. If the bidder relies on a contract performed by that entity, it must also identify the entity as a subcontractor. Where joint bidders rely on one another’s capacity, the bid must state each joint bidder’s share and the nature of its contract performance, using Form 6 where applicable.
The bid must meet the procurement documents and must not be conditional. The bidder must submit its price in the prescribed structure and the completed price form in Annex 3. Joint bidders must appoint an authorised representative and provide the power of attorney in Annex 6. The bidder must identify and justify any trade secrets; prices and evaluation-related figures may not be designated as trade secrets.
The offered meters must meet the requirements in Annex 1. The bidder must state the product names and submit manufacturer’s technical documentation or other evidence enabling the buyer to verify compliance; copying the technical specification from the procurement documents is not sufficient. The bidder must describe the data-communication solution and any additional service required. Any paid intermediary service must be provided by the bidder throughout the warranty period, and its cost must be included in the bid price. The bidder must prove its valid resale rights with a document from the manufacturer or its authorised representative, or a website reference confirming that it is an official reseller in Estonia. Any claimed equivalence must be explained and supported by evidence. The bidder must also confirm that the goods are not subject to international sanctions and do not originate from sanctioned regions.
