Compliance requirements
The bidder must declare whether it, or any member of its administrative, management or supervisory body or authorised representative, has been convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or offences involving child labour or human trafficking. The bidder must also declare whether it has breached tax or social security payment obligations. For Estonian tax debts, a debt below EUR 100 is not treated as a tax debt where the statutory conditions apply; a tax debt whose payment has been rescheduled is also treated separately. Foreign bidders are assessed under the rules of their country of establishment.
Other grounds include insolvency or similar proceedings, bankruptcy, liquidation, assets administered by a liquidator or court, suspension of business, serious professional misconduct, competition-distorting agreements, an unmanageable conflict of interest, and involvement in preparing the procurement that creates an unavoidable competitive advantage. Grounds also cover significant or repeated failures under previous public contracts resulting in early termination, damages, price reductions or penalties; breaches of environmental, social or labour-law obligations; false or misleading information, withholding information or failing to provide requested documents; and attempts to improperly influence the procurement or obtain confidential information. National grounds include enabling the unlawful employment of a foreign national, being subject to an international sanction, and conviction for tax offences. Where legally available, the bidder may provide evidence of remedial measures taken to demonstrate restored reliability.
