Compliance requirements
A bidder will be excluded if any of the grounds in § 95(1) of Estonia’s Public Procurement Act apply. The bidder must confirm that it and the relevant persons authorised to represent, control or make decisions for it have not been convicted of enabling unlawful employment of a foreign national, including allowing work in breach of the applicable employment conditions or paying below the statutory wage rate; unlawful use of child labour; or an offence related to human trafficking. The bidder must also confirm that it has no outstanding national taxes, duties or environmental charges, or tax or social security contribution debts under the law of its country of establishment, and that awarding the contract would not breach an international or Estonian government sanction. If the bid involves a foreign company, documents confirming the absence of exclusion grounds must be provided for that company and its relevant representatives. The contracting authority may request further evidence where the information cannot be verified in a public register.
Qualification criteria and exclusion grounds
The bidder must hold a trading account in the electronic guarantees of origin register managed by Estonia’s system operator, Elering AS; the contracting authority will verify this. The bidder must provide the names and personal identification codes of any persons authorised to represent, control or make decisions for the bidder who are not visible in the Estonian commercial register, or confirm that there are no such persons. A foreign bidder must provide evidence of its representative’s authority and, where requested, documents confirming the absence of exclusion grounds for the company and relevant representatives. If the person submitting the bid is not the bidder’s legal representative, a power of attorney must be submitted. Joint bidders must appoint an authorised representative, submit their authorisation and confirmation, and accept joint and several liability for contract performance.
