Purchase of fuel for Põltsamaa municipality vehicles

The exclusion grounds cover relevant convictions of the bidder or its representatives, including participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorism financing, child labour and human trafficking. They also include unpaid taxes or social security contributions; insolvency, bankruptcy, liquidation or suspended business activities; serious professional misconduct; agreements intended to distort competition; conflicts of interest or involvement in preparing the procurement that cannot otherwise be remedied; serious failures under previous contracts; false or misleading information, failure to provide required information or documents, and improper attempts to obtain confidential information. Environmental, social and labour-law violations, unlawful employment of foreign nationals, international sanctions and certain tax offences are also covered. Where legally applicable, the bidder may provide evidence of measures taken to restore its reliability. The notice sets the arrears threshold at EUR 0; in Estonia, a tax-debt certificate is not issued for a debt below EUR 100, excluding interest not established by an administrative act, or where payment has been rescheduled.

The machine-readable notice does not specify financial-capacity, experience, staffing or other separate qualification criteria; these must be checked in the official tender documents. For compliance, the bidder must ensure that the relevant fuel can be obtained at a filling station in Põltsamaa or within 3 km of the town, 24 hours a day, seven days a week. This applies to petrol 95, petrol 98 and diesel for Lot 1, and LPG for Lot 2. By submitting a bid, the bidder confirms acceptance of all tender-document conditions. Conditional bids are not permitted. Any information claimed as a trade secret must be identified and justified; the bid price and other figures or indicators used in the evaluation may not be designated as trade secrets.
