The bidder must confirm that none of the mandatory exclusion grounds apply. These grounds include final convictions of the bidder or relevant representatives for participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment or violating conditions applicable to the employment of foreign nationals; unlawful use of child labour or human trafficking; and outstanding state tax, payment or environmental-charge debts, or tax and social-security payment debts under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information or failed to provide required qualification information or additional documents. The bidder must also confirm that its registered office or place of residence is not in the Russian Federation or the Republic of Belarus. Materials, equipment, goods and components originating from or produced in Russia or Belarus may not be used in the works; the contracting authority may request certificates of origin. In a joint tender, the joint tenderers must appoint an authorised representative and submit the relevant power of attorney.

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the start of the procurement. At least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party’s representative and contact details, and the procurement reference numbers where applicable. At the contracting authority’s request, evidence of proper performance must be submitted unless the information can be obtained from public or private databases without significant expense. The team must include a person with valid switching rights for the switching operations associated with the works in the 0.22–20 kV electrical network. For low-voltage-only works, at least low-voltage switching rights are required; where switching on the medium-voltage side is needed, both low- and medium-voltage switching rights are required. This person must be registered in Elektrilevi’s partner portal before the tender deadline. The bidder must have a designated person responsible for work operations, registered in Elektrilevi’s partner portal before the tender deadline. The team must also include a person leading electrical works who has valid A-level competence and/or a qualification at least equivalent to level 6 under the Estonian Qualifications Act, possesses the relevant evidence as at the tender submission date, and is registered in the partner portal before the deadline. The bidder must provide the required information about the authorised contract signatory and the contract-performance contact person; a power of attorney must be submitted if signing authority does not arise from the articles of association. The required tender forms, including the previous-contract list and price table, must be completed and submitted.
