Compliance requirements

The bidder must confirm that none of the mandatory exclusion grounds apply. These grounds include relevant criminal convictions of the bidder or its management, supervisory or authorised representatives for participation in a criminal organisation, breach of professional duties, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment or paying a foreign worker below the statutory wage rate; unlawful use of child labour or trafficking-related offences; and outstanding state taxes, duties or environmental charges, or tax or social-security payment arrears under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an important term of a previous public contract, resulting in termination, withdrawal, a price reduction, compensation or a contractual penalty, or that has submitted false information or failed to submit information or additional documents required for qualification. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods and components manufactured in or originating from Russia or Belarus may not be installed or used in performing the works. The contracting authority may request certificates of origin as evidence.

Qualification criteria and exclusion grounds

The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the procurement during the 60 months preceding the start of the procurement. At least one of these contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including their performance periods, the contracting parties’ details and the contact details of the client’s representative; for public contracts, the relevant procurement reference numbers must also be provided. At the contracting authority’s request, evidence of proper performance must be submitted unless the information can be obtained from public or private databases without significant expense. The team must include a person with valid switching rights for the relevant works in the 0.22–20 kV electricity network. For low-voltage-only works, at least low-voltage switching rights are required; where medium-voltage switching is needed, both low- and medium-voltage switching rights are required. This person must be registered in Elektrilevi’s partner portal before the tenders are opened. The bidder must have a person designated as responsible for the work operation, registered in Elektrilevi’s partner portal before the tender submission deadline. The team must also include an electrical works manager with valid A competence or a qualification corresponding to at least level 6 under the Estonian Professional Qualifications Act, holding the relevant certificate at the time of submission and registered in the partner portal before the deadline. The bidder must provide the names, positions and contact details of the person or persons authorised to sign the contract and of the contact person responsible for contract-performance matters. If the signing authority does not arise from the articles of association, a power of attorney must be included. The tender must contain a completed price table with all unit-price fields filled in and must comply with the tender documents and the specified Elektrilevi management-system guidance. Conditional or additional terms are not permitted.
