Participation requirements

Tender requirements are available in the official tender documents.

Compliance requirements

The bidder must confirm that neither the company nor its management, supervisory body members, authorised representatives or other persons able to represent or control it have been finally convicted within the relevant five-year period of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, the unlawful use of child labour or other forms of human trafficking. The bidder must also not have outstanding tax or social security payment obligations. The notice specifies a threshold of EUR 0 for tax and social security payment debts; under Estonian rules, certain debts below EUR 100 or debts covered by a payment rescheduling arrangement may be treated differently when issuing a tax debt certificate. The bidder must confirm that it has not enabled the employment of a foreign national staying in Estonia without a lawful basis or violated the applicable employment conditions, including minimum pay requirements, and that entering into the contract would not breach an international or Estonian government sanction. The bidder must confirm that it will not use a subcontractor who would have to be replaced under the applicable procurement rules. Where an exclusion ground exists, information on the conviction, exclusion period and any measures taken to restore reliability may be required. A tender may be rejected if the contract would be void because of sanctions or if the required confirmations are not provided.

Qualification criteria and exclusion grounds

For each lot, the bidder must have a registered environmental permit in the waste sector. The contracting authority will verify the registration and its validity in public databases, and the bidder must provide the environmental permit number. The bidder must submit the tender in the structure specified in the pricing and evaluated indicators sheet and include all costs required for the activities described in the procurement documents and their annexes. A joint tender requires a power of attorney authorising a representative to act on behalf of the joint tenderers in matters related to the procurement and contract. The tender must comply with all procurement document requirements and may not be conditional. The machine-readable notice did not specify separate financial turnover, previous experience or staffing requirements; any additional requirements must be checked in the official tender documents.
