Compliance requirements
The bidder must confirm that neither the company nor its management, supervisory body members, procurist or other authorised representatives have been convicted of participation in a criminal organisation, breach of duty of integrity, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. The same applies to convictions concerning unlawful employment of foreign nationals, violations of employment conditions or payment below the statutory wage, unlawful use of child labour or human trafficking. The bidder must not have outstanding national tax, duty or environmental charge obligations, or outstanding tax or social security contributions under the law of its country of establishment. The contracting authority may also exclude a bidder that has substantially or repeatedly breached an important term of a previous public contract, or that has submitted false information or failed to submit required qualification information or additional documents. The bidder must confirm that its registered office or residence is not in the Russian Federation or the Republic of Belarus. Materials, equipment, goods and components originating from or produced in Russia or Belarus may not be installed or used; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
The bidder must have properly completed at least three contracts for electrical construction works similar to the subject of this procurement during the 60 months preceding the commencement of the procurement. At least one of these contracts must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the other contracting party's details and the client's contact information, including telephone number and email address; public contracts must also include their reference numbers. Evidence of proper performance must be submitted upon request unless the contracting authority can obtain it from public or private databases without significant expense.
The bidder must have a person responsible for managing electrical works who holds a valid A-level competence or a qualification of at least level 6 under the Estonian Qualifications Act. The person must hold the required evidence of qualification when tenders are submitted and must be entered in the Elektrilevi Partner Portal before tenders are opened.
For switching operations in the 0.22–20 kV electricity network, the bidder must have a person with valid switching rights who is entered in the Elektrilevi Partner Portal before tenders are opened. For works limited to low voltage (0.22–1 kV), at least low-voltage switching rights are required. In other cases, both low-voltage and medium-voltage switching rights are required, including where low-voltage works require switching on the medium-voltage side. The bidder must also have a person responsible for the work operation, entered in the partner portal before tenders are opened.
The tender must include a completed price table in the prescribed format, with all unit-price fields filled in. The bidder must provide the required information about the contract signatory and the contact person for contract performance; a power of attorney must be added where signing authority does not arise from the articles of association. The bidder must identify and justify any trade secrets or state that the tender contains none. The bidder must also confirm compliance with the restrictions on Russian and Belarusian companies and with the prohibition on using materials, equipment, goods or components originating from or produced in those countries.
