Compliance requirements
The bidder must confirm that neither the bidder nor its management, governing or supervisory body members, authorised representatives or controlling persons have been finally convicted within the last five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the unlawful use of child labour or other forms of human trafficking. The bidder must also confirm that it has no outstanding tax or social security payment obligations. The national exclusion grounds additionally cover enabling an unlawfully staying foreign national to work or allowing a foreign national to work in Estonia in breach of the applicable conditions, including by paying less than the statutory wage, and being subject to an international sanction. Where relevant, the bidder must provide information on the conviction or breach, exclusion period, remedial measures and supporting evidence. Tax and social security payment obligations may be regularised through payment or a binding payment arrangement, including applicable interest and late-payment charges.
Qualification criteria and exclusion grounds
The bidder must submit at least one reference for a project carried out from August 2021 onwards and within the five years preceding the commencement of the procurement, in the field of business continuity, risk management, crisis preparedness or emergency planning. The project must have included interviews, workshops or risk assessment sessions with stakeholders. The reference must include the project description, total value and currency, the bidder’s area of responsibility, the relevant amount and currency, the performance period, the contracting authority’s name and contact details, and any available electronic source or supporting information. If the bid is submitted jointly, the joint bidders must appoint an authorised representative and submit the relevant power of attorney. The bidder must identify and justify any trade secrets, while the bid price and other prohibited evaluation-related numerical information may not be classified as trade secrets. The bidder must confirm that the bid complies with all tender document requirements, that it is unconditional, and that the price is presented in the required structure.
