Compliance requirements
The tender passport asks bidders to declare whether the company or its relevant managers or representatives have been convicted in the past five years of offences such as participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, child labour or human trafficking. It also covers unpaid taxes or social security contributions; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business; serious professional misconduct; anti-competitive agreements; conflicts of interest or involvement in preparing the procurement; serious failures under previous contracts; false or misleading information, failure to provide required information or documents, and attempts to obtain confidential information or influence the procedure improperly. National grounds include enabling illegal employment of foreign nationals, being subject to international sanctions, and certain tax convictions. The bidder must also confirm that no international sanctions prohibit the contract. Where a ground applies, the bidder may describe measures taken to restore its reliability where permitted.
Qualification criteria and exclusion grounds
For both lots, the bidder’s average annual net turnover from heating-system installation, maintenance and repair during 1 January 2023–31 December 2025 must be at least EUR 100,000. The bidder must have at least three years’ work experience in maintaining, repairing or installing heating substations and must list at least one properly performed contract for heating-system maintenance, repair or installation for each year from 2023 through 2025. The bidder must have at least two employees with an initial level 4 heating and cooling systems mechanic qualification or higher, and a foreperson with a level 5 property technical maintenance master qualification or equivalent. The bidder confirms these qualifications in the tender passport and must provide the relevant certificates if requested by the contracting authority. The tender also requires confirmation that the bid complies with the procurement documents, is unconditional, and uses the prescribed pricing structure; any claimed equivalence must be explained and supported with evidence. For a joint bid, the bidders must appoint an authorised representative and provide their power of attorney. The bidder must confirm that it will not use subcontractors or suppliers covered by the stated Russian sanctions restrictions for more than 10% of the contract value, and will not involve a subcontractor that must be replaced under the applicable rules. The offer must also include the required sanctions-related confirmations and completed price table for the relevant lot.
