Compliance requirements
The bidder and relevant members of its administrative, management or supervisory bodies, or persons authorised to represent, make decisions for or control it, may be excluded for final convictions within the previous five years, or while an exclusion period remains in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
Exclusion grounds also include breaches of tax or social-security contribution obligations; bankruptcy, insolvency, liquidation, suspended business activity, arrangements with creditors or a comparable situation; serious professional misconduct; competition-distorting agreements; an unmanageable conflict of interest; involvement in preparing the procurement that creates an unremediable competitive advantage; and significant or persistent failures under previous contracts resulting in early termination, damages, price reduction or comparable sanctions. Grounds further include false or misleading information, failure to provide required information or documents, and attempts to improperly influence the procurement or obtain confidential information. Breaches of environmental, social or labour-law obligations may also be grounds for exclusion.
National grounds include enabling a foreign national to work without a legal basis or in breach of the applicable employment conditions, entering into a contract in breach of international or national sanctions, and—at the contracting authority’s discretion—conviction for tax offences. The notice describes a zero-euro threshold for tax and social-security debts; under the stated national rules, a tax-debt certificate is not issued where the debt, excluding interest not established by an administrative act, is below EUR 100 or payment has been rescheduled. Foreign bidders are assessed under the rules of their country of establishment.
