Compliance requirements
The bidder must declare whether it or its representatives have relevant final convictions, including for criminal-organisation offences, corruption, fraud, terrorism-related offences, money laundering, child labour or human trafficking, and whether it has breached tax, social-security, environmental, social or labour-law obligations. Other grounds include bankruptcy or insolvency, liquidation, suspended business activity, serious professional misconduct, competition-distorting agreements, conflicts of interest, involvement in preparing the procurement, serious failures under previous contracts, false or misleading information, failure to provide requested documents, and attempts to obtain confidential information or influence the procedure improperly. The bidder must also confirm that contracting with it would not breach international or national sanctions. A mandatory ground concerns enabling an unlawfully present foreign national to work or breaching the applicable employment conditions. Where a ground applies, the bidder may provide information about measures taken to restore its reliability where permitted. Under Estonian rules, a tax-debt certificate is not issued for a debt below EUR 100 or where payment has been rescheduled.
Qualification criteria and exclusion grounds
For Lot 3, the bidder must have properly performed at least two catering contracts for large events during the three years preceding publication of the contract notice. Each event must have had at least 800 participants, and the contracts must have a combined value of at least EUR 40,000. The contracts may still be in progress. The bidder must list the contracts in the European Single Procurement Document, including their dates, values and counterparties, and submit confirmation from the other contracting party with the bid. The bidder must have performed the required contracts itself and may not rely on another entity’s capacity for this criterion. This requirement applies only to Lot 3.
For every lot bid, submit the participation application using Form II and the service description and price using the relevant Excel form: Annex 1 for Lot 1, Annex 2 for Lot 2 or Annex 3 for Lot 3, as well as the price information in the procurement register. The bid must meet the relevant service description; quoted prices bind the contracting authority for the first contract and do not entitle the bidder to additional payments. Joint bidders must provide the authorisation and joint-and-several-liability confirmation in Annex 5, Form I. The bidder must also make the required declarations on sanctions, equivalence and business secrets. For each lot, it must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers with the specified Russian citizenship, residence, establishment, ownership or representation links. Any claimed equivalence must be explained and supported with evidence.
