Compliance requirements
The tender passport requires declarations concerning convictions of the bidder or its relevant managers, representatives or controlling persons for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or human trafficking. Grounds also cover unpaid taxes or social security contributions; breaches of environmental, social or labour obligations; bankruptcy, insolvency, liquidation, creditor arrangements, similar proceedings, administration of assets by a liquidator or court, or suspended business activities; serious professional misconduct; agreements with other businesses to distort competition; conflicts of interest that cannot otherwise be resolved; involvement in preparing this procurement that creates an unremediable competitive advantage; significant or repeated failures under earlier contracts resulting in termination or comparable sanctions; and false or misleading information, failure to provide required information or documents, or attempts to obtain confidential information or improperly influence the procedure.
National grounds include enabling an illegally present foreign national to work or breaching the conditions for employing a foreign national, entering into a contract that would violate international or Estonian sanctions, and relevant tax-related convictions. Tax and social-security contribution debts are grounds, subject to the stated Estonian rules: a tax-debt certificate is not issued where the relevant debt is below EUR 100 or payment has been rescheduled. If a ground applies, the bidder may provide evidence of measures taken to restore its reliability where permitted for this procurement.
Qualification criteria and exclusion grounds
The bidder must have acted as the main contractor on at least 2 similar building or building-complex design projects, properly completed during the 36 months preceding the start of the procurement. Each building must have an enclosed net floor area exceeding 750 m². The projects must include preliminary design and main design and/or detailed design, including an issued building permit; at least one must have been delivered using BIM. The buildings’ principal intended use, accounting for at least 50%, must correspond to use classes 11220, 11300, 12100, 12200 or 12600. If requested, the bidder must provide access to a reference project’s BIM model. The tender passport must list the contracts, their dates, values excluding VAT, the bidder’s role and the clients’ contact details. The contracting authority may request client confirmations and may ask for additional explanations or documents, which must be provided within 5 working days of the request.
For the full contract period, the team must include a separate architect with professional qualification ‘Authorised Architect, level 7’ or higher, or an equivalent or higher qualification, and a project manager with either ‘Chartered Construction Engineer, level 7’ or higher (building construction; design management and/or preparation of building design documentation) or ‘Authorised Architect, level 7’ or higher, or an equivalent or higher qualification. The architect and project manager must be different people. The bidder must provide their details and qualification certificate numbers, and evidence of equivalent qualifications or authorisation to perform the work in the person’s country of establishment where applicable.
The bidder must confirm that its tender complies with the procurement documents; conditional tenders are not permitted. Any claimed equivalence must be explained and supported with evidence. Joint bidders must provide an authorisation appointing their representative. The bidder must identify and justify any trade secrets, but may not classify the tender price or specified evaluation-related numerical information as confidential. The bidder must also provide the required confirmation concerning restricted subcontractors and suppliers under EU sanctions rules.
