Compliance requirements
Exclusion grounds include final convictions within the previous five years, or an exclusion period still in force, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and the unlawful use of child labour or human trafficking. Grounds also include unpaid taxes or social security contributions; bankruptcy, insolvency, liquidation or comparable proceedings; an arrangement with creditors; assets administered by a liquidator or court; and suspended business activities.
A bidder may also be excluded for serious professional misconduct, agreements intended to distort competition, an unmanageable conflict of interest, involvement in preparing this procurement that creates an unavoidable competitive advantage, or serious or persistent failure under a previous contract resulting in early termination, damages, a price reduction or penalties. Other grounds include breaches of environmental, social or labour obligations; submitting false information, withholding required information or documents, or improperly seeking confidential information; and enabling the unlawful employment of a foreign national. The latter is a mandatory ground. Separate grounds concern international sanctions and convictions for tax offences, the latter being a voluntary ground. Where permitted, the bidder may provide evidence of measures taken to restore its reliability.
