Compliance requirements
The bidder must declare whether it or its management, supervisory or representative persons have relevant convictions, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and child labour or human trafficking offences. The declaration also covers serious breaches of environmental, social or labour obligations; insolvency, bankruptcy, liquidation, creditor arrangements, suspended business activity or comparable situations; serious professional misconduct; agreements intended to distort competition; conflicts of interest or involvement in preparing this procurement where the resulting advantage cannot otherwise be prevented; and significant or repeated failures under previous contracts that led to early termination, damages, price reductions or penalties.
The bidder must also declare whether it has submitted false or misleading information, withheld required information or documents, improperly sought confidential information, or attempted to influence the procurement decision. Grounds also concern unpaid taxes or social security contributions, unlawfully enabling a foreign national to work, international sanctions, relevant tax offences, applicable local tax debts and any restriction on the bidder’s right to participate. Where the law and procurement allow it, a bidder affected by an exclusion ground may provide evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The bidder’s total net turnover must have been at least EUR 500,000 in each of the last two completed financial years, 2024 and 2025. If this information is not available in a public database, the bidder must provide the two annual reports or relevant extracts when requested.
Within the 36 months before the procurement began, the bidder must have performed, under at least one contract in each category, street-maintenance work worth at least EUR 500,000 excluding VAT and green-area maintenance work worth at least EUR 500,000 excluding VAT. The relevant services must have been accepted by the client, although the contract need not be completed. The bidder must provide contract lists showing values, dates, client details and contact information, and procurement reference numbers where applicable.
The people responsible for the quality of street-maintenance work and green-area maintenance must each have at least 36 months’ experience as a manager in the relevant field and have been responsible for at least one relevant contract worth EUR 200,000 excluding VAT. If either person is not directly employed by the bidder, the bid must include that person’s confirmation of actual participation in contract delivery. The street-maintenance quality lead must have at least a Level 6 road-engineering qualification in road construction, construction management and/or road maintenance, or an equivalent qualification. The green-area maintenance quality lead must have at least a Level 4 qualification as a landscape gardener or gardener, or an equivalent qualification. The bidder must provide the required information in the procurement passport and submit supporting qualification evidence on request.
The bidder must submit a CV for at least one area manager responsible for directing maintenance work. The area manager must have at least secondary education and 36 months’ experience managing street-maintenance work, including responsibility for at least one maintenance contract worth EUR 100,000 excluding VAT. If this person is not directly employed by the bidder, the bid must include confirmation of actual participation. Experience must be stated to the nearest month. If a specialist’s education or professional qualification was not obtained in Estonian, that specialist must have Estonian language proficiency at least at B2 level, evidenced by a certificate. CVs must cover the required education, competence and experience of all required specialists.
The bidder must have, or be able to obtain or lease, a service centre no more than a 30-minute drive from the maintenance area. Evidence of the centre or a written agreement to obtain or lease it must be submitted. The bidder must also have, or be able to obtain or lease, the machinery and equipment required by the tender documents; it must provide the completed equipment schedule and evidence of availability or a written agreement to obtain or lease the equipment. If subcontractors are used, the bidder must provide the required information about them, their representatives, the nature of the subcontracted work and its percentage share.
