Compliance requirements
The bidder, its management, administrative or supervisory board member, procurator, or any person authorised to represent, decide for or control the bidder must not have been convicted of participation in a criminal organisation, breach of a duty of integrity, corruption, fraud, terrorism, money laundering or terrorist financing offences. Such persons must also not have been convicted of unlawfully enabling an illegally staying foreign national to work or breaching the conditions for a foreign national’s employment in Estonia, including paying less than the required wage, or of illegal use of child labour or trafficking in human beings.
The bidder must not have outstanding state tax, duty or environmental charge liabilities, or tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder for materially or repeatedly breaching an earlier procurement contract, or for submitting false information about compliance with qualification requirements or failing to submit required information or documents.
Businesses established in the Russian Federation or the Republic of Belarus may not participate. Materials, equipment, goods or components produced in or originating from those countries may not be used in the works. The contracting authority may require certificates of origin as evidence.
Qualification criteria and exclusion grounds
Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the contract. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the client representative’s contact details and, for public contracts, the reference numbers. At the contracting authority’s request, evidence of proper completion must be provided.
The team must include a person with the switching rights required for work-related switching in the 0.22–20 kV electricity network, registered in Elektrilevi’s partner portal before the bids are opened. For low-voltage works only, at least MP switching rights are required; in other cases, both MP and KP switching rights are required. The bidder must also have a person responsible for the work operation, registered in the same portal before the tender submission deadline.
The person managing the electrical works must hold a valid A-level competence or a qualification corresponding to at least level 6 under the Estonian Occupational Qualifications Act, together with the relevant evidence, at the time of bid submission. This person must be added to Elektrilevi’s partner portal before the tender submission deadline. The bid must include a properly completed price table with all unit-price fields completed, comply with the tender documents and be unconditional. The bidder must provide the details of the contract signatory and contact person and, where necessary, a power of attorney. Joint bidders must submit a power of attorney appointing an authorised representative. The bidder must describe any trade secrets or state that the bid contains none; the bid price and other prohibited figures may not be classified as trade secrets.
