Compliance requirements
A bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, its procurist or another person authorised to represent, direct or control it, has been convicted of participation in a criminal organisation, breach of an integrity obligation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies to convictions for enabling an unlawfully residing foreign national to work or breaching the conditions for employing a foreign national in Estonia, including paying wages below the statutory rate, as well as convictions related to the unlawful use of child labour or human trafficking.
The bidder must not have outstanding national tax, payment or environmental-fee debts, or tax or social-security contribution debts under the law of its country of establishment. The contracting authority may also exclude a bidder for a substantial or repeated breach of important terms of a previous public contract where this resulted in withdrawal from or termination of the contract, a price reduction, compensation for damage or a contractual penalty. Exclusion may also result from providing false information about compliance with the qualification requirements or failing to submit required information or documents.
An undertaking established or resident in the Russian Federation or the Republic of Belarus may not participate. The bidder must confirm that it is not established or resident in either of those countries.
Qualification criteria and exclusion grounds
Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of the tender. At least one contract must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the contracting party’s representative and contact details, and procurement reference numbers where applicable. Evidence of proper performance must be provided upon request, unless the contracting authority can obtain it from public or private databases without significant cost.
The bidder must have a person responsible for managing electrical works who holds a valid A-level competence or, within the meaning of the Professions Act, a qualification of at least level 6. The person must hold the relevant certificate when tenders are submitted and must be registered in Elektrilevi’s partner portal before tenders are opened.
The bidder must have an employee with the switching rights required for work-related switching operations in a 0.22–20 kV electricity network, and that employee must be registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage works only, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required. The bidder must also have a person appointed as responsible for the work operation, registered in the same portal before tenders are opened.
The tender must include a properly completed price table with all unit-price fields filled in and must take account of the instructions for completing management-system document V178. The bidder must provide the details of the contract signatory or signatories and the contact person for contract performance, and must attach a power of attorney where necessary. The bidder must identify and justify any trade secrets or confirm that the tender contains no trade secrets. Materials, equipment and goods, including their components, may not originate from Russia or Belarus; the contracting authority may request certificates of origin as evidence.
