Compliance requirements

The bidder, its management, supervisory board members, procurist or other authorised representatives must not have been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Convictions relating to enabling the unlawful employment of foreign nationals, including paying below the statutory wage rate, as well as illegal child labour or human trafficking, also constitute mandatory exclusion grounds. The bidder must not have outstanding national taxes, payments, environmental charges or equivalent tax or social security debts under the law of its country of establishment. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract, or that has provided false information or failed to submit required information or additional documents. Participation is not permitted for entities established or domiciled in the Russian Federation or Belarus. Materials, equipment, goods and components originating from or produced in those countries may not be installed or used; the contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this procurement. At least one of the contracts must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, the other contracting party’s details and the client representative’s telephone number and email address, and the procurement reference numbers where applicable. Upon request, evidence of proper performance must be provided unless the contracting authority can obtain the information from public or private databases without significant expense. The bidder must have a person with valid switching rights for work-related switching operations in the 0.22–20 kV electricity network. This person must be registered in Elektrilevi’s partner portal before tenders are opened. For low-voltage-only works, at least low-voltage switching rights are required; in other cases, both low- and medium-voltage switching rights are required where applicable. The bidder must also have a validly authorised person responsible for the work operation, registered in the partner portal before tenders are opened. The person leading the electrical works must hold valid A competence and/or a qualification corresponding to at least level 6 under the Occupational Qualifications Act, possess the relevant proof at the time of tender submission and be registered in the partner portal before tenders are opened. The tender must adopt all procurement-document conditions; conditional or supplementary tenders are not permitted. The price must be submitted using the required table, with every unit-price field completed. The bidder must provide the authorised contract signatory’s name, position and contact details, appoint a contract-performance contact person and submit a power of attorney if signing authority does not arise from the articles of association. The bidder must identify and justify any trade secrets; the tender price and other prohibited evaluation-related figures may not be designated as trade secrets. The bidder must also confirm compliance with the origin restrictions for materials, equipment, goods and components.
