Compliance requirements
The bidder must declare whether it or its representatives have relevant final convictions, including for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, terrorist financing, child labour or human trafficking. Other grounds include unpaid taxes or social security contributions; breaches of environmental, social or labour law; bankruptcy, insolvency, liquidation, creditor arrangements or suspended business activities; serious professional misconduct; agreements aimed at distorting competition; conflicts of interest or involvement in preparing the procurement; early termination of previous contracts or related damages or penalties; false or misleading information, withheld information or failure to provide requested documents; and conduct intended to obtain confidential information or improperly influence the procedure. National grounds also cover enabling unlawful employment of foreign nationals, being subject to international sanctions and relevant tax offences. The bidder must provide the required declarations and, where applicable, information about corrective measures. The notice sets a zero threshold for tax and social security arrears; the stated Estonian tax-certificate rules include exceptions for arrears below EUR 100 or deferred payment.
Qualification criteria and exclusion grounds
The bidder must have completed at least one equivalent service contract within the 36 months before the procurement began. The contract must have lasted at least one year and involved provision of the required volume of organic food, with more than 190 diners served at the same time on repeated occasions. A contract still in progress may be used if at least one school year had been completed by the time the bid is submitted. The bidder must provide information enabling the contracting authority to verify the reference, including the contract period and value and the client’s details; contact information may be requested if necessary. The bid must comply with the tender documents and may not be conditional. Prices must follow the structure in the prescribed 2027–2028 price form. The bidder must identify and justify any claimed trade secrets; the bid price and other specified evaluation figures cannot be treated as trade secrets. Joint bidders must appoint an authorised representative and include the relevant power of attorney. The bidder must confirm that the offered service meets the requirements and provide evidence of equivalence where applicable. It must also confirm that offered goods are not subject to international sanctions and do not originate from sanctioned regions.
