Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1) of Estonia’s Public Procurement Act apply. Before concluding the contract, the contracting authority will verify that the successful bidder is free of these grounds through the public procurement register’s information exchange. If necessary, the bidder must provide evidence that the grounds do not apply.
Qualification criteria and exclusion grounds
The bidder, or each joint bidder required to be registered under the laws of its country, must be registered in a commercial or similar register. It must provide a copy of a valid registration certificate or, if it is not legally required to register, a copy of its founding document. The contracting authority will check current details of Estonian legal entities in the Commercial Register.
During the 36 months preceding the start of the procurement, the bidder must have completed contracts similar to this procurement with a combined value of at least EUR 20,000. Submit the list using Part II of Form 3, stating each contract’s value, date of conclusion and information about the other parties.
The bidder must be the manufacturer’s official sales partner and reseller in Estonia for the offered licences and hold partner status granted by the manufacturer. Submit a confirmation and supporting evidence, such as a relevant extract from the manufacturer’s website.
The bid must comply with the procurement documents; conditional bids are not allowed. Submit the declaration and bidder confirmations using Part I of Form 2, including the bid’s validity period, which must be at least three months. Provide a power of attorney for the bidder’s representative if the signatory is not listed in the registration certificate as authorised to represent the legal entity. Joint bidders must appoint an authorised representative and submit the original power of attorney granted to that representative.
Submit the completed price offer form (Form 4), signed by the person or persons authorised to represent the bidder, and enter the total price of the JIRA licences and consultancy service in the required price structure. State which information in the bid is a trade secret and give reasons, or indicate that the bid contains no trade secrets. The bid price and component prices, among other specified evaluation-related figures, may not be designated as trade secrets.
