Compliance requirements
The European Single Procurement Document asks the bidder to declare whether it or relevant representatives have been convicted within the previous five years, or remain subject to an exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or human trafficking. Other grounds include unpaid taxes or social-security contributions; bankruptcy, insolvency, liquidation or comparable proceedings; an agreement with creditors, court-appointed asset management or suspended business activity; serious professional misconduct; agreements intended to distort competition; an unmanageable conflict of interest; involvement in preparing this procurement that creates an unremediable competitive advantage; early termination of a previous contract or comparable sanctions; false or withheld information, failure to provide requested documents, or improper attempts to influence the procedure or obtain confidential information; and breaches of environmental, social or labour-law obligations. National grounds also cover enabling unlawful employment of a foreign national, being subject to applicable international sanctions, and convictions for tax offences. The tax and social-contribution questions state a threshold of EUR 0; the notice explains that an Estonian tax-debt certificate is not issued for debt below EUR 100 (excluding interest not fixed by an administrative act) or where payment has been rescheduled. Where permitted, the bidder may describe measures taken to restore its reliability.
