Compliance requirements
The bidder must confirm that neither the company nor its management, supervisory or authorised representatives are subject to exclusion grounds. These include final convictions within the last five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, and child labour or other forms of human trafficking.
The bidder must not have outstanding tax or social security payment obligations. The stated threshold for both categories is EUR 0, subject to the rules concerning tax debts below EUR 100 or deferred payment arrangements.
Further exclusion grounds include breaches of environmental, social or labour-law obligations; bankruptcy, insolvency, liquidation or comparable situations; assets administered by a liquidator or court; suspended business activity; serious professional misconduct; anti-competitive agreements; conflicts of interest; involvement in preparing the procurement that creates an advantage; serious or repeated breaches of earlier public contracts resulting in early termination, damages or sanctions; and false or misleading information, failure to provide required information or documents, or attempts to improperly influence the procurement.
The bidder must also confirm compliance with the national exclusion grounds concerning unlawful employment of foreign nationals, international sanctions and convictions for tax offences. Where an exclusion ground applies, the bidder may provide information about remedial measures restoring its reliability if permitted by the applicable rules or tender documents.
Qualification criteria and exclusion grounds
For both lots, the bidder must hold or obtain by the time of contract performance a valid community transport licence under section 39(1) of the Public Transport Act or a taxi licence under section 54(1). The licence number must be provided, or the bidder must explain the application for the licence. The licence information is checked through the Register of Economic Activities.
The bidder must provide a list of at least one comparable service contract completed within the 36 months preceding the procurement. The list must state the contract value, dates, contracting authority and contact details. The bidder must complete Form 1, “List of previous reference contracts”.
For Lot 1, the bidder must own or have available at least 6 M1-category vehicles complying with the technical specification and submit Form 2, “List of vehicles used by the carrier”. For Lot 2, the bidder must own or have available at least 2 vehicles suitable for transporting passengers with disabilities and meeting the technical specification, also documented using Form 2.
The bid must follow the required pricing structure and comply with all tender-document conditions. Conditional bids are not permitted. In a joint bid, the bidders must appoint an authorised representative and submit the required power of attorney. The bidder must identify and justify any trade secrets; the bid price and other prohibited numerical evaluation indicators may not be designated as trade secrets. No specific turnover requirement or separate financial-capacity threshold is stated in the provided notice.
