Compliance requirements
The bidder must confirm that neither it nor its representatives or management and supervisory body members is subject to any exclusion ground. The checks cover, among other matters, final criminal convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, and the use of child labour or other forms of human trafficking. The bidder’s payment of taxes and social security contributions, bankruptcy, insolvency or liquidation proceedings, agreements with creditors, suspension of business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, material breaches of previous public contracts, and the submission of false information or failure to provide required documents are also covered. Additional national exclusion grounds concern enabling illegally residing foreign nationals to work, international sanctions and tax offences. Where an exclusion ground applies, evidence of remedial measures restoring reliability may be submitted in certain circumstances.
Qualification criteria and exclusion grounds
The machine-readable procurement passport does not state precise turnover, previous experience, staffing, professional qualification or other separate qualification or suitability requirements; any such requirements must be checked in the tender documents. To demonstrate compliance, the bidder must submit, for each lot for which it bids, a technical compliance table containing explanations and references to the technical parameters of the offered equipment, as well as an equipment price offer document in free form. The price must be submitted according to the structure provided in the procurement’s evaluation table. The bidder must confirm that the tender complies with the tender documents; where an equivalent solution is offered, its equivalence must be explained and supporting evidence attached. Conditional tenders are not permitted. In a joint tender, a power of attorney for the joint bidders must be attached. The bidder must confirm that it will not use subcontractors or suppliers connected with sanctioned Russian persons or entities for more than 10% of the contract value and that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
