Compliance requirements

The bidder must confirm that neither the company nor its administrative, management or supervisory body members, procurists, or persons authorised to represent, decide for or control the company have received a final conviction during the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or terrorism-related offences, money laundering or terrorist financing, or the illegal use of child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations and must not have breached obligations concerning the employment of foreign nationals staying in Estonia without a legal basis. The bidder must confirm that concluding the contract would not breach an international or Estonian Republic sanction. The required declarations and, where necessary, evidence must be provided for all exclusion grounds; measures taken to restore reliability may be described and evidenced where applicable.

Qualification criteria and exclusion grounds

During the 60 calendar months preceding the procurement procedure, the bidder must have constructed at least two skate parks under at least two contracts, with each skate park measuring at least 500 m². The bidder must provide a list of previous works and evidence that they were performed properly, including a description of the work, the bidder’s responsibilities, the value, the period, the client and the client’s contact details. The bid must comply with all tender documents; conditional bids are not permitted. The required construction price tender form and a preliminary four-month schedule broken down by week must be submitted. Where relevant, the bidder must explain the equivalence of the proposed solution and provide supporting evidence. The bidder must confirm that it will not engage a subcontractor who would be subject to replacement during contract performance, and must submit the names, contact details and legal representative information of known subcontractors by the start of contract performance. Where the environmental conditions apply, furniture must use legally sourced wood; REACH Candidate List substances exceeding 0.1% by mass, or their absence, must be declared; dismantling and repair instructions must be provided; a warranty of at least two years must be given; and spare parts or functionally equivalent elements must remain available for at least two years after handover.
