Compliance requirements

The bidder must confirm that the company, its management or supervisory body members, and persons authorised to represent or control it have not received a final conviction within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. The bidder must also have no breach relating to the payment of taxes or social security contributions, unlawful employment of a foreign national, or a situation in which awarding the contract would breach an international or Estonian sanction. Where applicable, the bidder must describe measures taken to restore its reliability and provide relevant evidence. The bidder must confirm payment of taxes and social security contributions or provide information enabling the contracting authority to verify this.

Qualification criteria and exclusion grounds

The bidder must have a person qualified to perform owner’s supervision. The qualification must be demonstrated by a professional qualification under the Estonian Professional Qualifications Act or by another competence certificate issued under applicable legislation. The bidder must provide the person’s name, occupation or professional field, qualification and experience details, and other required information. For qualifications obtained abroad, conformity with the requirements is assessed and certified by the Technical Regulatory Authority in accordance with the Recognition of Foreign Professional Qualifications Act. The tender must be prepared in the required form. The tender price must be submitted according to the structure set out in the worksheet for award criteria and rated indicators; the price entered there takes precedence over any price stated elsewhere. In a joint tender, a power of attorney from the joint tenderers must be included. The bidder must identify any information claimed as a trade secret and provide the justification, or confirm that the tender contains no trade secrets. The tender price and other prohibited numerical indicators may not be classified as trade secrets.
