Compliance requirements

The bidder must not be subject to exclusion grounds relating to participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The checks cover the bidder and its management, administrative or supervisory body members, as well as other persons authorised to represent or control it; in general, final convictions from the last five years or a still-valid exclusion period are relevant. Exclusion may also result from failure to pay taxes or social security contributions, enabling an unlawfully staying foreign national to work, or being a subject of an international sanction. For tax and social security obligations, the document specifies a threshold of EUR 0, while noting that the tax authority does not issue a tax-debt certificate where the debt is below EUR 100 or payment has been deferred. The bidder must confirm that it will not use subcontractors or suppliers subject to the stated Russian-related sanctions for more than 10% of the contract value, and that the offered goods are not subject to international sanctions and do not originate from sanctioned regions. First-tier subcontractors will be checked and must submit a European Single Procurement Document. A subcontractor that would have to be replaced due to an exclusion ground may not be used during contract performance. The bidder must provide a description of the reference contract, its value, performance period, contracting authority and contact person, together with the other information required in the European Single Procurement Document. The bid must include the technical description and unit-price table, and the tender price must be submitted according to the specified structure. If the proposed solution does not exactly match a referenced standard, label or other technical basis, the bidder must explain its equivalence and provide supporting evidence.
